Terms of Service

1. General
- These Terms govern the use of Jalvo.eu and the Jalvo reverse proxy service (the “Service”).
- The Service is provided by Krzysztof Balicki, trading as Web Systems, ul. Gen. Jarosława Dąbrowskiego 249/23, 93-231 Łódź, Poland, VAT ID PL7292462454, e-mail: biuro@web-systems.pl (the “Provider”).
- The customer is any person or organisation that created an account (the “Customer”). Where the law requires, these Terms distinguish Customers who are consumers.
2. The Service
- The Service provides proxy servers (NGINX) that receive traffic for the Customer’s domains and pass it to the server the Customer specifies (the Customer’s hosting).
- In the dashboard the Customer adds a domain, enters the IP of their hosting, picks a proxy server and points the domain’s A record to that server’s IP. Configuration changes usually reach the proxy within a few minutes.
- The Provider issues and renews free Let’s Encrypt certificates for domains that point to a proxy server. The Customer may upload their own certificate instead.
- The Provider may change a proxy server’s IP when the server provider or security requires it, and informs the Customer by e-mail in advance where possible.
- The Provider makes reasonable efforts to keep the Service running but does not guarantee a specific availability.
3. Account
- Using the Service requires an account and a confirmed e-mail address.
- The Customer keeps their password confidential and is responsible for actions taken from their account.
- The Customer may delete the account in the dashboard at any time. Deleting the account ends the Service and removes the domains from the proxy servers.
4. Plans, prices and payment
- The Service is a paid subscription. Plans: Standard (up to 10 different proxy IPs at once) and Pro (all proxy IPs). The number of domains is not limited.
- The subscription is paid in advance for 3 or 12 months. 12 months cost 10% less than four 3-month periods. Current prices are on the pricing page.
- Prices are net. VAT is added as required by law: 23% for customers in Poland and consumers in the EU; no VAT under the reverse charge for businesses in other EU countries with a valid EU VAT ID (checked in VIES); no Polish VAT for customers outside the EU.
- Payments are handled by Stripe. The subscription renews automatically for the same period and is charged to the saved payment method unless the Customer cancels it.
- An electronic invoice is issued after each payment and made available in the dashboard and by e-mail.
- A change of plan or billing period applies from the next renewal.
5. Cancellation, non-payment and grace period
- The Customer may cancel the subscription in the dashboard at any time. It stays active until the end of the paid period and is not renewed. There is no refund for the unused part of a period, without prejudice to the right of withdrawal in section 7.
- If a renewal is not paid or the subscription ends, the Service keeps working for 7 more days (grace period). After that the Customer’s domains are no longer served by the proxy servers. They stay in the dashboard and work again once the subscription is paid.
- Domains that have been unregistered for more than 7 days, or whose registration expired more than 7 days ago, may be removed from the Service, unless their DNS still points to the proxy server.
6. Referral program
- Every Customer has a referral link in the dashboard.
- A new Customer who signs up through a referral link gets 50% off their first subscription period (3 or 12 months). It cannot be combined with other discount codes.
- The referrer gets as many free months of their own plan as the referred Customer’s first paid period (3 or 12), whatever the plans of both. The reward is given once per referred Customer, only for their first purchase, 14 days after the payment if it was not refunded.
- The reward moves the referrer’s next payment date. Without an active subscription, the months wait on the account and are used with the next purchase.
- Referring oneself (including through a second account, the same card, VAT ID or e-mail) gives no reward. The Provider may refuse a reward in case of abuse.
7. Right of withdrawal (consumers)
- A consumer may withdraw from the contract within 14 days of concluding it without giving a reason, by e-mail to biuro@web-systems.pl.
- If the consumer asked for the Service to start before the withdrawal period ends and then withdraws, they pay for the Service in proportion to the time it was provided. The Customer makes this request by ticking the consent box when ordering.
8. Acceptable use
- The Customer may route through the Service only domains they are entitled to use, and only lawful traffic.
- In particular, it is forbidden to send spam, run phishing, spread malware, publish content that infringes the law or third-party rights, attack computer systems, or hide such activity behind the Service.
- If these rules are broken, or after a justified notice from an authorised body, the Provider may stop serving the affected domain immediately and informs the Customer.
9. Liability
- The Customer is responsible for the content and operation of the sites served through the Service and for their DNS and hosting configuration.
- Towards Customers who are not consumers, the Provider’s liability is limited to the fees paid by the Customer in the last 3 months and excludes lost profits.
10. Complaints
- Complaints can be sent to biuro@web-systems.pl with the Customer’s details, a description of the problem and the expected solution.
- The Provider answers within 14 days of receipt.
11. Personal data
- Personal data is processed as described in the Privacy Policy.
- By routing the traffic of their sites through the Service, the Customer entrusts the Provider with processing the personal data of visitors to those sites (IP address, time, request, referrer, browser identifier) to the extent and for the purpose needed to provide the Service, for the time the Service is provided (Article 28 GDPR).
- The Provider processes this data only on the Customer’s documented instructions, which are these Terms and the Service configuration in the dashboard; ensures confidentiality of the persons with access; applies appropriate security measures; uses sub-processors (server providers in the USA and Europe) and informs the Customer in advance of any change, giving them the chance to object; helps the Customer with data subject requests and the obligations under Articles 32-36 GDPR; reports personal data breaches to the Customer without undue delay; deletes the data when the Service ends (logs after 10 days at the latest); makes available the information needed to demonstrate compliance with Article 28 GDPR and allows audits.
12. Changes and final provisions
- The Provider may change these Terms for important reasons (changes in law, in the scope of the Service, security) and informs Customers by e-mail at least 14 days before the change applies. A Customer who does not accept the change may delete the account before that date.
- A price change does not affect a period already paid and applies from the next renewal.
- Polish law applies. This does not deprive consumers of the protection of mandatory provisions of the country of their habitual residence.
